Selling off-plan before handover: NOC fees, developer consent, timing

The exit route most buyers never ask about until they need it. Costs, consents and realistic timelines.

Most buyers never ask about the exit until they need it. Then they discover it has conditions. This is the route out of an off-plan purchase before the building completes, and what it costs.

It is called assignment, and it needs permission

Selling before handover means assigning your SPA to a new buyer. It is normal and it happens constantly, but it is not automatic — the developer has to consent, and they attach conditions.

The threshold. Most developers require a minimum percentage paid before they will allow an assignment, commonly 30–40%. Below that you cannot sell at all. Ask what the threshold is before you buy, not when you want out.

The NOC. A No Objection Certificate from the developer, which carries a fee. Budget a few thousand dirhams, though it varies and some developers charge considerably more.

Their transfer fee. Separate from the NOC and separate from the DLD. Some developers charge a percentage of the sale price for the privilege of substituting one buyer for another.

The costs on the way out

  • Developer NOC fee
  • Developer assignment or transfer fee, sometimes a percentage
  • DLD fees on the new registration
  • Agency commission, typically 2%, and on a resale you are usually the one paying it

Two per cent of the sale price plus the developer’s fees is a meaningful bite out of a gain that may not be large. On a short hold it can eat the gain entirely.

Timing, realistically

Four to eight weeks from agreeing a price to completing an assignment, assuming the developer is responsive and the buyer’s funds are ready. It can run longer if the developer’s NOC desk is slow, and they are slower at quarter end.

The part worth thinking about now

The market you sell into is the resale market for that specific building. On Central Island, where most of the archipelago’s launches sit, there will be genuine competition and a real price discovery process. On an island with two buildings, your exit price is whatever the one other seller is asking.

That is why market depth matters more than any render, and it is why the exit question belongs in the buying decision rather than after it.
